To the AMLRC Members:
It has been some time since the AMLRC last published an article. We apologize and it is time to explain why. During this time the club was experiencing negative, non-productive, and detrimental activity against it, a potential hostile takeover if you will. This activity most certainly threatened to jeopardized the health, viability, and financial position of the AMLRC. With the club’s treasury and charter at stake, the AMLRC had no choice but to file for a legal injunction which would stay this detrimental activity and prohibit any further action by the individuals who were attempting to tear apart the AMLRC. This injunction would serve to protect the club until a judge could hear the case.
Once the judge reviewed the initial documentation, he granted the injunction and the injunction notice was sent to all parties. The notice ordered the individuals who wished to harm the club to hold no further meetings that would involve club business. Although all parties involved were served, and signed the notices, these individuals chose instead to ignore the court order and proceeded to hold meetings and attempt to conduct club business.
An initial court date was set. During the court hearing, each side was allowed to present its case to the judge. The AMLRC presented significant evidence to the court of numerous situations and circumstances where the AMLRC experienced actions detrimental to the club. The defense’s only argument was that the judge did not have jurisdiction over the defendants; the defense did not present one item to dispute the evidence that was presented against it.
The judge ruled in favor of the AMLRC and a permanent injunction was granted. The defense then filed an appeal with the State Court of Appeals, once again claiming the judge did not have jurisdiction to rule on this case. This appeal was not upheld by the court. At that time the defendants decided they wanted to settle the case. In doing so, the defendants admitted wrongdoing and arranged a settlement with the AMLRC in exchange for being excused from the litigation. This settlement was twofold: the defendants willingly resigned from the AMLRC and paid a fine for their actions against the club. It should be noted, the club did not incur any net expenses to the treasury as the result of these legal proceedings. With this now behind us, we can finally move forward for the good of the club and the membership.
As part of the court proceedings, the AMLRC has some requirements to fulfill as well. As some of the individuals involved in the legal settlement were members of the AMLRC board and have now resigned, the judge instructed the President of the AMLRC to put a new board in place. This has been done. The judge also instructed that the AMLRC should hold an annual meeting of the membership which will be done at the Mini Lop Specialty Show in Kankakee at the end of April.
The AMLRC treasury remains strong, and our membership continues to grow. We are confident that we have put the troubles of the past behind us, and we can now continue to move forward as a membership driven, family oriented rabbit club.
